The GVH again initiates proceedings against eMAG


According to the authority, the company may have deceived consumers on several points with its commercial practices.

The Economic Competition Authority (GVH) has initiated proceedings against Extreme Digital-eMAG Limited Liability Company (eMAG) due to the alleged violation of the prohibition of unfair commercial practices towards consumers – the Public Service Communications Office of GVH informed our newspaper.

The GVH initiated competition supervision proceedings against eMAG because it noticed that the company was likely to:

  • from May 28, 2022, its publication practice related to consumer opinions is capable of deceiving consumers in making an informed transactional decision about the products,
  • July 25-28, 2023 in its “Crazy Days” campaign announced between
  • from October 31 provides consumers with untrue information about delivery deadlines,
  • from July 22, in the case of certain products, it will display as an advantage the 14-day right of withdrawal to which the consumer is entitled by law, as well as the product warranty period.

The initiation of the competition supervision procedure does not mean that the company has committed the violation. The procedure is aimed at clarifying the facts and thereby proving the alleged violation. The duration of the procedure is three months, which can be extended twice, each time by a maximum of two months, in justified cases.

In 2021, the GVH already investigated eMAG’s campaign holding practices, as a result of which – in addition to a fine of HUF 200 million – it obliged the companies subject to the procedure to implement their reparation commitments worth around HUF 4 billion. During the follow-up investigation evaluating the fulfillment of the undertakings, the national competition authority established that eMAG had fulfilled its obligations incompletely, therefore the Competition Council of the GVH hit the company with an additional HUF 50 million fine.
